EL CONSEJO DE LA UNIÓN EUROPEA,

Visto el Tratado constitutivo de la Comunidad Europea,

Visto el Reglamento (CE) no 1346/2000 del Consejo, de 29 de mayo de 2000, sobre procedimientos de insolvencia (1), y, en particular, su artículo 45,

Vista la propuesta de la Comisión,

Considerando lo siguiente:

(1) Los anexos A, B y C del Reglamento (CE) no 1346/2000 establecen las designaciones dadas en la legislación nacional de los Estados miembros a los procedimientos y síndicos a los que se aplica el Reglamento. En el anexo A se enumeran los procedimientos de insolvencia que se contemplan en el artículo 2, letra a), del Reglamento. En el anexo B se enumeran los procedimientos de liquidación que se contemplan en el artículo 2, letra c), del presente Reglamento y en el anexo C se enumeran los síndicos que se contemplan en el artículo 2, letra b), del Reglamento.

(2) El 13 de diciembre de 2007, la República de Letonia notificó a la Comisión, de conformidad con lo establecido en el artículo 45 del Reglamento (CE) no 1346/2000, modificaciones de las listas establecidas en los anexos A y B de dicho Reglamento.

(3) Como consecuencia de las modificaciones efectuadas en los anexos A y B del Reglamento (CE) no 1346/2000 tras la mencionada notificación de Letonia, debe hacerse una codificación de los anexos A, B y C del Reglamento para dar a todas las partes que participan en los procedimientos de insolvencia cubiertos por dicho Reglamento la necesaria seguridad jurídica.

(4) El Reino Unido e Irlanda están vinculados por el Reglamento (CE) no 1346/2000, y, en virtud del artículo 45 de dicho Reglamento, participan por lo tanto en la adopción y la aplicación del presente Reglamento.

(5) De conformidad con los artículos 1 y 2 del Protocolo sobre la Posición de Dinamarca anejo al Tratado de la Unión Europea y al Tratado constitutivo de la Comunidad Europea, Dinamarca no participa en la adopción del presente Reglamento y no está vinculada por el mismo ni sujeta a su aplicación.

(6) Por lo tanto, los anexos A y B del Reglamento (CE) no 1346/2000 deben modificarse y los anexos A, B y C codificarse en consecuencia.

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El Reglamento (CE) no 1346/2000 queda modificado como sigue:

1) En el anexo A, las designaciones relativas a la República de Letonia se sustituyen por las siguientes:

Artículo 2

Los anexos A y B quedan modificados con arreglo al artículo 1 y el anexo C del Reglamento (CE) no 1346/2000 se codifica y sustituye por los anexos I, II y III del presente Reglamento.

Artículo 3

El presente Reglamento entrará en vigor el día siguiente al de su publicación en el Diario Oficial de la Unión Europea.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en cada Estado miembro.
